Waiver of Liability

In consideration of Anton Strub, owner of SV. Little Swan, accepting my application, I agree to release claims, waiver of liability and assumption of risk, (collectively this agreement).

I waive any and all claims I may have now and in the future have against, and release from all liability and agree not to sue Anton Strub, his agents, his representatives, or family members associated with Anton Strub, for any personal injury, death, property damage(s), or loss sustained by me as a result of my participation with cruising on SV. Little Swan.

I am aware that Adventure Yachting, in addition to the usual dangers and risks, has additional dangers and risks such as extreme sudden and unexpected weather changes, remoteness to normal medical services or evacuation difficulties if I am disable, loss of earning, etc.

I accept all the inherent risk of the proposed adventure cruise(s) including the possibility of injury, property damage, or any other loss resulting there for.

I acknowledge that the enjoyment of adventure yachting is derived in part from the inherent risk incurred by traveling, and being actively involved in beyond the accepted safety of home or work and that these inherent risk contributes to much enjoyment and excitement and being a reason for my participation.

I agree, that if I suffer injury or illness, that the Master of the vessel or the owner, Anton Strub of SV. Little Swan can, at my cost, arrange medical treatment and /or emergency evacuation services as deemed essential for my safety.

In entering into this agreement I am not relying on any oral, written or visual representations, or statements made by Anton Strub, nor have I been induced or coerced to go on the adventure cruise(s), hence, I enter this agreement of my own free will.

I confirm that I am over 18 year of age and that I have read and understand this agreement prior to signing on and agree that this agreement will be binding by my heirs, next of kin, executors, administrators and successors.

I agree that this agreement shall be governed in all aspects and interpretation with the laws of Australia.
